Supreme Court Questions Jantar Mantar Protests, Seeks Centre’s Reply on New Venue Demand

The court asked the government to clarify whether Delhi needs an alternative protest location after concerns over facilities and public inconvenience.

The Supreme Court asked the government to respond on demands for another protest location in Delhi. The petition requested shifting demonstrations away from Jantar Mantar.

Petition highlights problems at Jantar Mantar

Petitioner Satish Chand Kaushik argued that Jantar Mantar does not suit large-scale protests and demonstrations. He described the location as impractical for extended gatherings. On Monday, 3 August, the matter reached a bench led by Chief Justice Surya Kant. The judges considered the issue important and asked Solicitor General Tushar Mehta to seek instructions from the central government. The court requested information about the government’s position on the matter. It also asked whether authorities could identify another suitable location.

According to the petition, Jantar Mantar lacks basic arrangements like drinking water, toilets, sewage facilities, and food options. The petition also mentioned problems caused by demonstrations in the area. Furthermore, protests at the location affect traffic movement. The petitioner said local residents, pedestrians, and emergency services face difficulties.

Court seeks clarity while protecting protest rights

The Supreme Court asked the government to provide a clear response regarding alternative arrangements. The court wanted to know whether another appropriate protest site exists. However, the court has previously recognised peaceful protests as a fundamental right. The court also stated that authorities must consider public safety and convenience during such demonstrations.

Therefore, the issue now involves balancing citizens’ right to protest with the needs of people living around protest areas.
