NALSAR Row Reaches Supreme Court: CJI Surya Kant Tells BCI to Stay Out

CJI Surya Kant said students should face no action for expressing opposition and urged bar councils not to block their enrolment as lawyers.

Chief Justice of India Surya Kant addressed the controversy involving NALSAR students and the Bar Council of India. He said BCI need not intervene if students choose to oppose him. Moreover, Surya Kant asked every state bar council against blocking their enrolment as lawyers.

The Chief Justice made these remarks after the Supreme Court considered an order issued by BCI. During proceedings, counsel representing the Bar Council provided an important update. The lawyer said BCI had already withdrawn that order yesterday.

Chief Justice Opposes Action Against Students for Expressing Views

Surya Kant then spoke about possible action against students. He recalled remaining highly active on several issues during his own student years. Therefore, he argued that authorities should not punish young people merely for expressing their views.

The Chief Justice added that younger citizens should freely speak even when they oppose people in authority. He said, if any young person speaks against us, let them do so.

According to Surya Kant, students should receive their licences quickly. Moreover, he wants them to enter the Supreme Court and practise law.

CJI Offers a Different Response to Attempts Affecting Students’ Careers

Surya Kant also said students could receive opportunities through the Legal Services Authority. He presented this approach as a constructive answer to those seeking career consequences against them.

The Chief Justice argued that professional opportunities would provide the strongest response. Therefore, he rejected attempts to damage careers because students voiced disagreement.

His remarks centred on protecting expression while allowing young lawyers to continue their professional journey. At the same time, he clearly asked bar councils to avoid interfering with their enrolment.
