Shankaracharya took U Turn, Moves High Court for Anticipatory Bail in Sexual Harassment Case

Swami Avimukteshwaranand Saraswati files plea before Allahabad High Court as FIR registered under BNS and POCSO sections.

The sexual harassment matter involving Swami Avimukteshwaranand Saraswati has now reached the Allahabad High Court. Meanwhile, the Shankaracharya submitted an anticipatory bail application seeking legal protection.

Advocates Rajarshi Gupta, Sudhanshu Kumar, and Shri Prakash presented the petition before the court. Additionally, the bench may soon schedule a hearing on the request.

Complaint Originated in District Court Under Section 173(4)

Earlier, Ashutosh Brahmachari, disciple of Tulsi Peethadhishwar Swami Rambhadracharya, approached the district court under Section 173(4). Subsequently, ADJ Rape and POCSO Special Court Judge Vinod Kumar Chaurasia in Jhunsi directed police to register a case and initiate investigation.

Following judicial direction, officers recorded the case accordingly.

FIR Registered Under BNS and POCSO Provisions

Jhunsi police station registered an FIR against Swami Avimukteshwaranand, his disciple Mukundanand Giri, and two to three unidentified persons. Authorities invoked BNS Section 351(3) along with several provisions under the Protection of Children from Sexual Offences Act.

Specifically, officers applied Sections 5L, 6, 3, 4(2), 16, and 17 under POCSO. Furthermore, investigators have already begun examining the allegations.
